Its ages since you posted this but I was just re-reading this whole thread (I have a vague idea about doing a counter piece) and you comment made me stop and think.
I just went for the 3GS, sold my 3G for £300 and signed up again to O2 for another 18 months (purely more sensible for me vs £538 on PAYG!)
Now, I have used the 3GS for a couple of weeks, and was intending not to Jailbreak it, but without that, you are bang on, I can not even change my SMS tone to the one I always use (a rather tacky spoken "you have new message" in a ting tong from Little Britain sort of voice  )
BUT, with a JB, (bloody simple as these days), I can do whatever I want.
So, Apple don't control MY iPhone  )

Which is fine, but the EULA that you have agreed to states that you have licensed the device/OS from apple. You have not bought it. They might not have the same control, but it still ain't yours in the eyes of the law!

Which is the same EULA for a WM device from a SP IIRC.

Not as I understand it. Sure, the OS is only ever license (same for all software - you buy a license to use. you don't buy a copy of the software). As I understand it, the iPhone is pretty special in extending this to the device itself.

Aye, but if you buy a SP-branded WM device the device also belongs to the SP. Not sure it's the same for sim-free devices. In practice though, the EULA would be subject to the unfair contract terms act 1977 anyway and wouldn't stand up in court or be enforced by Apple (IMHO).

Pah, the law you say?
I laugh in the face of the law, why just the other day I hit 71 MPH on the A14!

 Not sure I agree with that. I always reserve "old fart" status for those over 40 (  ) and I'm not there just yet!
It's interesting the font issue as even on the 2.8" devices I always find the default font size too big and set it to the level one above smallest.

I tell you what mate, on holiday, (we went with a few mates and there families), the lads went out for a drink in Playa De Las Americas in Tenerife... Boy, did we feel old, and yes, I am over 40!!
