Re: iPhone ad rapped as 'misleading'
Whilst the ASA are correct, it proves how toothless they are. That Ad has been running for several weeks. The advertising campaign is over. Anyone how has seen it has already been misled. What do Apple care if they get a slap on the wrist? Their job is done. In fact, they used the opportunity to put out even more misleading information in their press-release (something along the lines of "whilst other phones only give you access to some parts of the web, the iPhone does give you access to all websites"). Whilst it wasn't inaccurate, it was deliberately worded to make the informed believe that all other handsets have restricted web access and the iPhone is the only handset that allows you to access them all.
It really is pointless having a watchdog who can only slap a company on the wrist AFTER the damage has been done. Someone this morning suggested a 3-strikes rule. If you are in breach 3-times in a 12 month period you are not allowed to advertise for 12 months. That would certainly make companies take more care and fewer risks with their ads.
At the moment, the rules are such that the likes of Ryannair, Apple and broadband companies are free to push the boundaries as much as they can without fear of serious repercussion.
